On the website of Dr. Irena Sandler, you can browse and purchase from a virtual store a store of paintings and artworks by Irena Sandler. Use of this website shall be deemed the user's agreement to all the terms set out in these Terms & Conditions.

The website and store may contain links to various websites, or recommended links, that we consider relevant for you. Entry to the site constitutes agreement to the content offered. All artworks sold on the website and in the Irena Sandler store are offered for purchase at the stated price.

Cancellation, Exchange & Defective Artworks

The provisions of these Terms regarding cancellation of purchase, exchange, and defective artworks are in addition to the provisions appearing on the site under the "Exchanges, Returns & Cancellations" tab.

Cancellation of Purchase An order may be canceled from the moment it is placed (on-the-spot cancellation) and up to 14 business days from receipt of the shipment, accompanied by the purchase invoice in accordance with the Consumer Protection Regulations (Cancellation of a Transaction), 5771-2010, and the Consumer Protection Law, 5741-1981. Order cancellation shall be made by telephone, in accordance with the provisions below and with any law.

  • Cancellation before shipment cancellation of an order before it has been sent by the Company. Upon cancellation, the amounts paid for the order will be refunded to the customer.
  • Cancellation after shipment cancellation after the artwork has already been sent, subject to the customer returning the artwork by registered mail only to the Company's address specified in these Terms, in its original protective packaging, undamaged, and in the same condition in which it was received. An artwork returned that does not meet these requirements will not entitle the customer to a refund or any other credit. In every cancellation, the customer shall bear the cost of the shipping fees. The customer will be credited only after the artwork is received at the Company's premises.

The credit will always be issued under the same terms under which the transaction was charged, and to the payment method through which it was made. Credits from the credit-card company and PayPal: the credit will be transferred to the credit card with which the order was placed; 5% of the transaction value is non-refundable; the credit will be transferred in accordance with the schedules of the credit-card company / PayPal. It is clarified that no refund will be given for an artwork that has been damaged or altered.

Exchanges An exchange will be possible only up to 14 days from the date of receipt of the shipment, accompanied by the purchase invoice and subject to the conditions for cancellation after shipment above. No exchange will be given for paintings made to personal order or to custom size. In the case of an exchange, the artwork's value will equal its price at checkout on the day of the exchange, and not its price on the day of purchase. The cost of shipping in the case of an exchange or return is at the customer's expense.

Defective Paintings / Artworks If the customer does not notify the Company of any defect in the artwork within 48 hours of receiving it, this shall constitute notice that no defect was present, and the customer shall have no claim against the Company or anyone on its behalf regarding the existence of any defect.

Anyone making a purchase on the site declares by the very act of making it that they are aware of the site's Terms & Conditions and the rules applicable to purchasing artworks through the site, and agrees to their application.

Eligibility to Purchase

Persons aged 18 and over who hold a valid ID card and a valid credit card from one of the Israeli credit-card companies are entitled to purchase on the site. Purchase of artworks will be made by credit card only.

A precondition for approval of the purchase by Dr. Irena Sandler is obtaining approval from the credit-card company to carry out the transaction. Without such approval, the transaction is not valid and the purchase will not be carried out.

To complete the purchase, the buyer must fill in personal details; doing so is a necessary condition for carrying out the purchase. Irena Sandler conditions the supply of paintings upon completion of the forms and confirmation of payment from the credit-card company.

Without derogating from the foregoing, Dr. Irena Sandler may prevent you from purchasing paintings or artworks in the store in any of the following cases:

  • If you deliberately provided incorrect details;
  • If you performed an act or omission that harms or may harm the Irena Sandler site and store, or harmed any third party, including site customers;
  • If you made improper use of the painting or artwork you purchased an unlawful act, such as providing false information about it, or any other misuse;
  • If you have previously, unlawfully, failed to pay for artworks you purchased from Dr. Irena Sandler;
  • If the credit card in your possession has been blocked or restricted in any way.

The Artworks Offered

In the store, Dr. Irena Sandler offers a variety of artworks, for which a price and terms have been set, as deemed appropriate at the sole discretion of Dr. Irena Sandler, who reserves the exclusive right to add or remove artworks, to determine the availability of each artwork, the manner of purchase, and the purchase price.

A precondition for approval of the purchase is that the purchased artwork is available. Accordingly, if the artwork cannot be supplied to the buyer due to unavailability, the Company will refund the amount paid or cancel the credit-card charge, and the buyer shall have no claim or demand against Dr. Irena Sandler in this regard.

Every artwork offered for purchase will be accompanied by at least the following details:

  • The price of the artwork and the available payment terms;
  • The cost of transport or shipping. Dr. Irena Sandler may condition supply to remote areas of the country upon a different transport price, or may choose not to supply an artwork and cancel the transaction at her sole discretion;
  • The manner and timing of supply of the artwork counted from the date the credit-card company approves the purchase;
  • A general description of the artwork.

Purchase Details & Payment

When making a purchase, the buyer must enter their personal details into the system, including name and address, as well as the number and type of the credit card with which they wish to make the transaction. The site operators will not be responsible for an error resulting from the buyer entering incorrect or any details into the system.

If the person making the purchase chooses not to leave their credit-card details, but rather to be contacted by telephone to provide them, the transaction will be considered complete only after the credit-card details have been provided.

The details of the purchase and the buyer will be used for the internal use of Dr. Irena Sandler and will not be transferred to any other party / third party, except to the credit-card company in order to obtain approval for the transaction. The buyer agrees that their details will be stored in the Company's database.

The buyer will be charged for the artwork via credit card immediately after the purchase, subject to the approval of the credit-card company.

Dr. Irena Sandler reserves the right to change these Terms, to add to them, and/or to remove any of their provisions. Every purchase is subject to the Terms in effect at the time, as published on the site.

The images of the artworks displayed on the site are images of the artworks you will purchase. In the event that an error occurs or is discovered in the description, price, payment terms, image, or any other material relating to an artwork, or in the receipt of data from the buyer, Dr. Irena Sandler may cancel the purchase at any time up until its supply to the buyer, without this being considered a breach of contract.

In any dispute concerning a purchase, the competent court in Tel Aviv-Yafo shall have sole and exclusive jurisdiction. Any notice to the buyer will be made according to the details entered into the system during the purchase; a notice sent by mail will be deemed to have reached the buyer within 7 days of the date it was delivered for dispatch.

Returns

Returns of artworks will be carried out only by prior arrangement with the site.

  • The artworks must be undamaged and in the same condition in which they were received, in their original protective packaging, intact and complete;
  • All items must be returned within 14 days of receipt, together with the original invoice. Items without an invoice will not be accepted;
  • The cost of transporting the artwork back to the site is the user's responsibility, as is any additional cost for shipping the returned artwork. Where additional costs exist such as taxes, brokerage fees, or shipping to other destinations in Israel and/or abroad the user will be charged for these;
  • If you wish to receive a refund for an artwork that was shipped to you free of charge, the cost of shipping the artwork to you will be deducted from the refund;
  • Upon the return of artworks and receipt of a refund, the buyer will be charged a cancellation fee of 5% of the artwork's value or ₪100, whichever is lower, plus the shipping fees;
  • Upon the return of artworks, the buyer will pay the cost of shipping even if the artworks were purchased without shipping fees;

Anyone making a purchase on the site declares by the very act of making it that the email address they provided is correct, as are the rest of the details, including the delivery address for artworks. Any error in providing the details will charge the customer with the costs arising therefrom.
